The information published on this website and other social is provided for the use of its visitors and you are advised that, although care is taken to ensure factual and technical accuracy, Flower Pilates cannot guarantee the accuracy or completeness of this information. Please be aware that information on this website and social channels may change from time to time. Flower Pilates shall have no liability arising from the use by any party of the information on this website and social channels.

Please read our terms and conditions (“T&Cs”) in full. The use of this website and social channels, the creation of an account for the online booking service, the making of a booking via the website and/or the booking service, email or over the phone are all subject to the T&Cs and you hereby agree and confirm by continuing to use the website and book services with Flower Pilates that you have read the T&Cs, you understand their meaning and importance and agree to be bound by them.

These T&Cs may change from time to time without notice, so please make sure you read them prior to making any bookings.

Introductions & Definitions

The services offered by Flower Pilates at any venue and medium, including virtual delivery, (the “Services”) are subject to the following T&Cs. In these T&Cs, “we”/”us”/”our” refers to services provided by Maria Florencia Dalinger (“Flor”) who trades as Flower Pilates with registered address at Second Floor, 26 Goodge Street, London W1T 2QG, and means all of them in relation to this website and “you”/”your”/”yours” means you, the student or client.

These T&Cs together with the booking confirmation (which may be oral or written), constitute the contract (the “Contract”) between us in relation to the Flower Pilates website and social media for the supply of services to you. The Contract shall not be varied in any way whatsoever unless agreed in advance in writing between the parties.

The following definitions apply: “Services” or “Service” means any information, services, activities, classes, workshops, appointments or personal training ordered and/or provided by Flower Pilates through via the website, any virtual platform (such as Zoom or Teams) or via any of its studios, and all services offered as part of any course, workshop or personal training. Any electronic information supplied to you by Flower Pilates will constitute part of a “Service” and not a product, with cancellation rights applying accordingly. References to a class, workshop, activity, appointment or personal training in these T&Cs mean a Service and are designated as such rather than a Service, for ease of understanding. “Website” means the website at the URL www.flowerpilates.co.uk or replacement website(s) from time to time. “Social Channels” refers to the “flowerpilates” and “flor.moves” accounts in Facebook, Instagram, LinkedIn and YouTube. “Packages” means any number of classes / types of classes combined, also referred to as “Blocks”, which can be booked with Flower Pilates.

Health Waiver & Limitation of Liability

  • By purchasing a Service or Services and booking Services with us either via the website, online booking system, or directly via Flor, you accept that in consideration of being permitted to participate in the Services, and use our equipment and facilities that on your behalf and that of any heirs and assigns you covenant not to sue and/or hold Flower Pilates, harmless against and waive and discharge Flower Pilates, against all responsibility or liability for injuries, health issues, damages, loss or death resulting from your participation in any of the Services or use of our equipment or facilities.

  • Flower Pilates, exclude all responsibility and/or liability for injuries, health issues, damages, loss or death resulting from or exacerbated by, your participation in any of the Services or use of the equipment or facilities, whether or not caused by Flower Pilates’ negligence. 

It is your responsibility to:

  • Check with your doctor about your suitability for our Services and obtain their written consent where necessary before making a booking/purchasing a Service. While Flor ensures a safe practice environment, there are inherent risks in any exercise programme and hence Flower Pilates does not accept any liability for any injury or illness you incur through taking any Services or by your failure to notify of any existing injuries, health problems or special needs before you attend your class, or to notify Flor prior to the start of your class.

  • Notify Flor by email, following the creation of your account and prior to booking/purchasing any Services of any health problem or injury you may have - including without limitation: spinal, bone, joint, tendon or ligament injuries; spells of dizziness; any cardiac irregularities; asthma (or any breathing difficulty); diabetes, epilepsy or any allergies which may impact your participation in any Services at Flower Pilates. Please also notify Flor at the start of every class/appointment.

  • Notify Flor by email before attending or taking part in any Service of any new circumstances affecting your health, that may impact your ability to participate in or continue to take part of Flower Pilates classes, and/or which may have arisen or worsened since your last class at Flower Pilates (if applicable).

  • You accept the risk of injury from performing exercises and using specialist equipment and participating in any Services, and you acknowledge and accept that any advice provided by Flower Pilates at no time constitutes professional medical advice or substitution for professional medical advice.

  • You agree and understand that following the strict instructions of Flor in every Service you take. Flower Pilates cannot be held responsible for any injury arising or being made worse by your failure to do so.

If you are pregnant or just had a baby:

  • It is your responsibility to inform Flower Pilates when completing the introductory forms, as well as via email prior to attending or verbally at the start of your classes of any pregnancy. Please inform Flor (in confidence) once your pregnancy has been confirmed in order to provide you with the best possible care and advice.

  • If you already regularly attend Flower Pilates classes during your pregnancy, you are advised to attend mixed level classes. Upon reaching week 16 of your pregnancy you are required to discuss your programme with Flor to ensure any necessary alterations are made to continue attending our classes.

  • If you are pregnant (and reaching your 16th week of pregnancy) and you are new to Flower Pilates, you may be limited to private session.

  • After giving birth you are advised that you can attend Mixed level classes after 6 weeks post medical clearance. Should you have a caesarean, you are advised to wait at least 12 weeks prior to resuming your Flower Pilates classes, following medical clearance. 

If you experience lower back pain:

  • It is your responsibility to inform Flower Pilates when completing the introductory forms, as well as via email prior to attending or verbally at the start of your classes of any back injuries or pains. Please inform Flor (in confidence) of any medical / back pains history in order to provide you with the best possible care and advice.

Classes: Etiquette & Personal Belongings

  • Please ensure you arrive on time for your Service as a courtesy to Flor and to your fellow students.

  • If it is your first class, please arrive at least 5 minutes prior to your scheduled class time. If you are more than 10 minutes late, Flor reserves the right to admit you into the class.

  • The starting warm-up is designed to help avoid injuries. If you are more than 10 minutes late for a regular class, Flor reserves the right to admit you into the class, for your safety.

  • Please note that if you are late, your reserved place may be given to another student. Independent of this, you will still be charged for the Service. It is your responsibility to ensure you arrive on time.

  • All personal belongings left at our studios during or outside of Services and opening hours are left at your sole risk and Flower Pilates is in no way responsible for their theft, loss or damage. You acknowledge that no claim may be brought for any loss, theft or damage to personal belongings or loss suffered as a result of any loss, theft or damage to personal belongings, left at the studio at any time.

Managing your Account, Bookings & Payments

  • You must be 16 or above to create an account online with us, and you can only create an account in your own name, and for your own Services. If you create an account for a third party, you agree to indemnify Flower Pilates against all liability, costs or claims incurred by your creation of this account. Please also notify Flor if you have created this account for a third party.

  • The online booking system shows the availability of Services on the date and time you select. Service availability changes as and when bookings are made or cancelled by students. It is your responsibility to ensure that you have made your booking and payment correctly. If you notify Flor within 1 hour of your incorrectly scheduled class, credit for the class will be returned to your account for re-booking. No refunds can be given where you have incorrectly booked a Service or made a payment. Flor can only credit your account with an amount equal to your purchase, to be set against a future package or class.

  • You can pay for Services using a credit or debit card. All prices are final, and services are non-refundable, save as detailed elsewhere in these T&Cs. Flower Pilates reserves the right to modify prices without prior notice.

  • The Services commence from and including the date of purchase of the Services, and not the date of your first booking.

Booking Terms & Conditions

Cancellations and refund are subject to the following:

  • All bookings are subject to a 12-hour cancellation policy. You can make any changes or cancellations with more than 12-hours notice online without losing your class. The class will be returned to your online account for future bookings.

  • You may change your booking at any time. To change or cancel a class, access your booking via the link on the confirmation email and proceed to use the booking service.

  • If you have any problems, please contact Flor directly letting her know of your intention to cancel your booking. Flower Pilates cannot be responsible for “late cancellations” if you do not contact Flor in writing prior to the 12-hour cancellation period.

  • You are responsible for checking the details of your booking at each stage of the booking and payment process. Refunds are only available where your Services have not expired. Refunds are discretionary and are not offered following 14 days from the date of the purchase of the Services. All refunds are subject to a £15 charge (the “Admin fee”) plus charging full price for any class booking, which you will be required to authorise and permit Flower Pilates to process prior to the refund taking place.

  • Partial refunds cannot be processed. Flower Pilates reserves the right to refund a partially used package, or alternatively, to credit you by alternative means after deduction of the Admin fee.

  • If a refund is agreed for a partially used package, you agree that the classes already used will revert to the single class price prevailing at the time of refund request, as packages incorporate a discount for buying in bulk. The balance, if any, following deduction of the Admin fee will be returned in accordance with these T&Cs.

  • The rights of cancellation, refund and any limitation in these T&Cs do not affect your statutory rights as a consumer. Refunds may only be credited to the credit or debit card originally used to make the purchase.

Prices and expiry periods are subject to the following:

  • Prices are subject to change without notice and special offers may be withdrawn at any time without notice.

  • All packages and classes are non-transferable and subject to the 12-hour cancellation policy.

  • Packages / Blocks of classes are valid for 6 weeks, unless stated otherwise at the time of purchase.

  • Single, regular classes are valid for 4 weeks, unless stated otherwise at the time of purchase.

  • Classes are only valid as per their stated conditions: online sessions can only be redeemed for live-online delivery, while private, duets or group sessions can only be redeemed as per their stated location at the time of purchase.

  • Flower Pilates reserves the right to allow for class cancellation at no cost, in cases where the booking was made in error.

  • It is your responsibility to check your account and keep abreast of your Services validity dates.

Holiday periods and extensions are subject to the following:

  • Package validity is not extended solely on the basis of closure or restricted hours due to bank holidays, with the exception of Christmas and New Year. Please ensure when you purchase your package that you will have sufficient time to use your Services as the schedule is subject to changes and Services are subject to availability. 

  • Packages can be extended by one calendar month from the date of expiry for the cost of £20. Flower Pilates reserves the right to extend your package, should it be expired at the time of requesting the extension.

  • Special Offers will not be extended, unless stipulated in the offer. The fee charged, if applicable, for the extension of a special offer depends on the special offer concerned. This is the case regardless of how many classes you have left to use.

  • Should you sustain an injury which prevents you from attending class, please supply a valid doctor’s note. Upon receipt Flower Pilates will extend the validity of your package at its discretion – at no cost to you. Flower Pilates reserves the right to further extend the package or require you pay the extension charge of £20.

  • Flower Pilates reserves the right to extend your package for any situations not covered above.

  • Sharing your package with a third party is not permitted. Package and classes are not transferable due to safety and liability reasons.

  • It is your responsibility to keep abreast of the expiry date of your Services and to request extensions. Flower Pilates will not be held responsible for your failure to do so.

In order to take part in Flower Pilates online classes:

  • You will require: (a) an internet connection with broadband wired or wireless (4G or above) with minimum download/upload speed of 4.0 MBps; (b) speakers and a microphone; (c) a webcam; (d) a dual-core 2Ghz or higher processor (intel i3 or AMD equivalent and above); (e) 4Gb RAM; and (f) an operating system of Windows 8 or later / macOS X 10.10 or later / Ubuntu 12.04 or higher / Mint 17.1 or higher / Linux 8.0 or higher / Fedora 21 or higher / OpenSUSE 13.2 or higher.

  • If using a tablet, it will need to run Windows 8.1 or higher.

  • For web browsers on mobile or desktops, it will require using an up-to-date version within 2 versions of the current version.

  • You are strongly encouraged to follow Flor’s layout guidance, available upon request, to ensure you can make the most of the classes.

  • It is your responsibility to ensure the aforementioned conditions are met to be able to benefit in full of Flower Pilates online classes. No refunds will be offered in the event your systems don’t meet the aforementioned minimum requirements.

  • Should you have any technical issues during a class, Flower Pilates will offer re-booking your class at no cost.

  • Flower Pilates reserves the right to offer a refund or provide credit for booking other class types, should issues persist.  

If Flower Pilates needs to cancel your booking or modify your scheduled classes:

  • A binding contract is not formed until Flower Pilates accepts your booking for a Service or block of Services. This is accepted upon issuing a booking confirmation or a waitlist confirmation via email, text or orally to you, by the online booking system or directly by Flor.

  • In the event of a website error or inaccuracy, due to Flor’s unavailability, Flower Pilates reserves the right to cancel all confirmed class bookings up to 60 minutes prior to the scheduled Service time. In the event of cancellation, Flower Pilates will be liable for the return of your class, allowing you to re-book. No further compensation shall be due to you. No refunds are available in the event of cancellation.

  • All Services are subject to availability. Flower Pilates will try to accommodate your preference, but this cannot be guaranteed. The schedule of Services is subject to change without notice, so please ensure that there are a number of days and class times that fit your schedule, as refunds cannot be offered on the basis of particular time slots on a particular day becoming unavailable, whether on a temporary or permanent basis.

  • In the event that Flower Pilates cancels a Service that you have booked, you will be contacted by email or phone and return your credit to your account for re-booking at your convenience. 

  • It is your responsibility to ensure that your details in your online account are up to date, as Flower Pilates uses them for all communication between us, and all communication from the booking system to you. 

  • Please always remember to check your spam folder.

Liability & Force Majeure

  • You agree to these T&Cs that your use of this website, the social media channels and our Services are on an “as is” and “as available” basis. On that basis, except as expressly set out in these T&Cs, Flower Pilates does not enter into conditions, warranties or other terms in relation to the website, the social media channels or the Services (including any implied term relating to quality or fitness for a particular purpose) or any guaranteed or predicted result.

  • The website and social media channels may include links to third party websites and co-branded sites. Flower Pilates may include these links and co-branded pages to provide you with access to information and services that are considered useful or interesting for your use, however, Flower Pilates is not responsible for the content of these websites and pages or for anything provided by them.

  • Flower Pilates is not liable for failure to comply with these T&Cs due to any event beyond our reasonable control, including, without limitation, the input of incorrect information by you.

  • Flower Pilates shall not be liable to you or deemed to be in breach of these T&Cs by reason of any delay in performing or any failure to perform the obligations in relation to these T&Cs, if the delay or failure was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, tempest, fire or accident, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), IT viruses or Internet downtime, labour, fuel, power failure or breakdown in equipment.

  • If any part of these T&Cs is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these T&Cs, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

  • These T&Cs shall be governed by and construed in accordance with English law and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.

  • These T&Cs together with the booking confirmation constitute the entire agreement between the parties unless otherwise expressly agreed in writing between the parties.

Intellectual Property (IP) Rights

  • You may use the website, social media channels and booking site for personal and lawful use and under these terms, you are not allowed to copy or use any material for any commercial purpose.

  • IP rights to the website and social media channels are owned by Flower Pilates.

  • You are not allowed to make any copies of any part of any resources available in the website and social media channels, include or create links to or from them without Flower Pilates written authority – unless you acknowledge / credit in writing the source of such resources.

  • You are not allowed to remove or change any copyright, trademark or other intellectual property right notices contained in the website or social media channels.

  • “Flower Pilates” is a registered trademark or application for registered trademark owned by Flor. Please refrain from using the Flower Pilates brand, logos or marks without written licence.

  • Please refrain from using the website and social media channels to post, upload or otherwise transmit material that is obscene or pornographic, threatening, menacing, racist, offensive, defamatory, infringing of any intellectual property or otherwise unlawful, to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into the website or social media channels or any other related computer system, to make excessive traffic demands, deliver viruses or forward chain letters or similar materials that may reasonably be expected to inhibit other users from using and enjoying the website and / or social media channels or damage or destroy Flower Pilates’ reputation.

  • Flower Pilates accepts no obligation to monitor the use of the website or social media channels. Flower Pilates however reserves the right to disclose any information as required by law and/or to remove, refuse to post or edit any information or resources, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these T&Cs or any breach of applicable law or regulation.

  • Flower Pilates will also, in its discretion, fully cooperate with law enforcement and other relevant authorities concerning any investigation of suspected unlawful activity or violation of network security.

  • As Flower Pilates may change the website and social media channels from time to time, it is recommended that you refresh your browser each time you visit the website to ensure that you access the most up to date version.

Your Personal Information

Usage of your personal information is governed by the Flower Pilates Privacy Policy which is accessible on this website and constitutes part of these T&Cs.
